From the supplier: Courts have become willing to recognize several kinds of claims against adoption intermediaries, generally based on the amount and accuracy of information they provide on the child's background and biological parents. Intentional misrepresentation is recognized everywhere, though negligence theory has less universal acceptance, and courts are reluctant to find a positive duty to investigate the child's medical background. Many states now have information-provision laws, and a model adoption law is making progress.
